Terms of Service

1. Title, Effective Date, and Overview
These Terms & Conditions (“Terms”) govern access to and use of Movva’s mobile application, related services, and challenge features. Movva is a Brazil-based platform where users create and join performance-based fitness/activity challenges, submit check-ins, and (when applicable) pay entry fees and receive prizes through in-app balance and withdrawal flows.
By creating an account, accepting these Terms, or using Movva, you agree to be bound by these Terms and by Movva’s Privacy Policy. If you do not agree, do not use Movva.
2. Definitions
For these Terms:
- “Movva” means the Movva platform and services operated in Brazil.
- “User” means any person who registers, accesses, or uses Movva.
- “Challenge” means a user-created activity competition with rules, date range, scoring mode, and optional prize.
- “Check-in” means a performance/activity record submitted to a Challenge (manual or tracker-based).
- “Entry Fee” means the amount a user pays to enter a paid Challenge.
- “Prize” means the reward associated with a Challenge, including cash prizes when configured.
- “PIX” means the Brazilian instant payment method used for BRL withdrawals.
- “Wise” means the payout provider used by Movva for non-BRL withdrawals (USD/NZD).
- “Stripe” means the payment processor used for incoming entry-fee payments.
- “EFIBank” means Movva’s business bank account receiving settled funds.
- “In-App Balance” means real-money balance in the User’s account in the User’s currency (BRL, USD, or NZD).
- “Account” means a User’s Movva account credentials and profile.
- “Admin” means a Challenge administrator designated by the Challenge creator (or later assigned).
3. Acceptance of Terms, Age, and Eligibility
3.1 Acceptance. You accept these Terms when you register, log in, or continue to use Movva.
3.2 Eligibility. If your jurisdiction requires a minimum legal age to enter performance-based paid challenges, you must meet that age requirement. If you are a minor, you may use Movva only with valid parental/legal guardian consent where legally permitted.
3.3 Account accuracy. You must provide accurate and current account information (including payout details when requesting withdrawals).
3.4 Currency/country setup. During sign-up, Movva collects country and currency and configures your account accordingly. Supported currencies are only BRL, USD, and NZD.
4. Service Description
4.1 Account and authentication. Movva supports:
- Email/password sign in
- Email/password sign up (public display name, email, password, acceptance of Terms/Privacy)
- Apple sign up/sign in flow
- User country and currency collection at registration
4.2 Challenge creation and configuration. Users can create Challenges with:
- Title, description, banner image
- Start and end dates
- Approval-required on/off
- Activity-tracker-only on/off
- Scoring mode (calories, distance, active days, or check-ins)
- Prize type (cash/custom/none) and related fields
4.3 Joining Challenges. Users join by code/link and may enter pending status where approval is required.
4.4 Check-ins. Users can add check-ins manually or from Apple Fitness import. Check-in fields may include title, description, date/time, duration, distance, calories, and optional image.
4.5 Profile, support, and withdrawals. Users can manage profile and payout account details, view ledger/balance, request withdrawals, and contact support through Contact Us messages.
5. Third-Party Services and Providers
5.1 Use of third-party providers. Movva relies on third-party infrastructure and service providers to operate portions of the app and payment flows, including (without limitation) Google services, Firebase, Apple services (including Apple Health integrations where enabled), Stripe, Wise, and other technical/payment providers used by Movva from time to time.
5.2 Third-party terms and policies apply. When you use Movva features that depend on third-party services, the applicable third-party terms of service, privacy policies, and technical rules also apply to your use of those features.
5.3 User responsibility for third-party compliance. You are responsible for complying with all applicable third-party terms connected to your use of Movva (for example, account, device, health-data, payment, and identity-verification requirements required by those providers).
5.4 Provider availability and changes. Movva may replace, add, or remove third-party providers at any time for operational, legal, security, or product reasons.
6. Non-Gambling Clause (Prominent)
6.1 Not gambling. Movva is not a gambling platform, sportsbook, casino, or game of chance.
6.2 Performance-based outcomes only. Challenge outcomes and winner selection are based on measurable activity/check-in metrics configured for the Challenge (e.g., calories, distance, check-ins, active days), not random chance.
6.3 No betting against others. Users participate in their own performance challenges and do not place speculative bets against unrelated third-party outcomes.
7. Health Disclaimer
7.1 No medical advice. Movva does not provide medical advice, diagnosis, or treatment, and is not a healthcare provider.
7.2 Informational/performance tool only. Any activity metrics, challenge content, or in-app information is provided for informational and motivational purposes only.
7.3 Consult qualified professionals. You should consult a licensed physician or other qualified health professional before starting, changing, or intensifying physical activity programs.
7.4 Assumption of personal risk. You are solely responsible for your health decisions and physical activity choices while using Movva.
8. User-Created Content and Responsibility
8.1 Your content. You are responsible for content and data you submit, including check-ins, messages, profile information, and images.
8.2 Lawful use. You must not post unlawful, infringing, fraudulent, abusive, or misleading content.
8.3 Challenge governance. Challenge creators/admins define and manage Challenge-level operations (membership approvals and moderation actions) within app functionality.
8.4 Report channel. Users may report issues through Contact Us. Movva targets responses within up to 24 hours.
9. Payments and Fees
9.1 Supported currencies. Movva currently supports only BRL, USD, and NZD.
9.2 Incoming payments. Entry fees are paid via Stripe. Stripe processes payment, and settled funds are received by Movva in its EFIBank business account.
9.3 Entry fee policy. The user joining a paid Challenge is responsible for the applicable entry fee. Before confirmation, checkout must clearly show the total amount and any applicable additional charges, including Stripe processing fees.
9.4 Payout transfer fees.
- BRL/PIX: no withdrawal fee is charged to the user.
- USD/NZD (Wise): transfer/payout fees are borne by the user requesting withdrawal. For Wise withdrawals, the transfer fee is calculated at the time of the withdrawal request by Wise (not by Movva).
9.5 Fee disclosure obligation. Movva must present an itemized fee line at transaction time: applicable charges must be displayed when creating/joining paid Challenges and, for non-BRL withdrawals, users must see a transfer-fee notice before confirming withdrawal. For Wise withdrawals, the exact transfer fee amount is defined and calculated by Wise at the time of the request.
9.6 Refund policy for paid cash Challenges.
- Member-funded cash prize (per-member entry fee): once a user pays to join, that amount is considered part of the prize pool and cannot be refunded while the Challenge remains active/completed. Refund is only available if the Challenge is canceled.
- Creator-funded cash prize: once the creator pays the prize amount, refund is only available if the Challenge is canceled by the creator or an admin. In this case, only the creator may request refund of the amount paid by the creator for prize funding.
- Refund amount basis: in both scenarios above, the refundable amount is the total amount paid minus applicable payment-platform processing fees.
- Refund destination: approved refunds are credited to the user’s In-App Balance (same currency), and the user may then request withdrawal/payout to their bank account through the available withdrawal flow.
10. In-App Balance
10.1 Nature of balance. In-App Balance is real-money value denominated in your account currency (BRL, USD, or NZD). It is not a token, points system, or crypto-asset.
10.2 Use in Challenge entry. Eligible users may apply In-App Balance as a discount of up to 50% of a Challenge entry fee.
10.3 Withdrawal minimum. Minimum withdrawal request amount is 5 units in your account currency (BRL 5, USD 5, NZD 5).
10.4 Cutoff time. Withdrawal requests submitted by 16:00 (Brasilia time) are initiated on the same business day. Requests submitted after cutoff are initiated on the next business day.
10.5 Maximum limit. There is currently no maximum withdrawal amount limit.
10.6 Withdrawal methods and timelines.
- BRL (PIX): Movva collects full name, CPF, PIX key type, and PIX key; Payout initiation/processing may take up to 5 business days, and completion may vary based on banking windows and operational checks.
- USD/NZD (Wise): Movva collects full name and email and sends the payout instruction to Wise. Payout initiation/processing may take up to 5 business days; final receipt time depends on Wise verification/KYC and user completion of required Wise data. Movva is not responsible for Wise verification failures or third-party transfer delays.
10.7 Holidays and verification. Local holidays and KYC/compliance verification requirements may delay payout completion.
10.8 Non-transferability/no interest. In-App Balance is non-transferable between users, accrues no interest, and may not be sold, assigned, or pledged.
10.9 Not a bank. Movva is a technology platform and is not a financial institution, payment bank, or deposit-taking institution.
11. Disputes, Check-ins, and Winner Determination
11.1 Creator/admin-managed verification. Movva does not proactively verify the factual truth of each check-in. Challenge creators/admins manage challenge participation and moderation tools provided in the app.
11.2 Admin powers. Admins may approve pending members, remove members, ban/unban members, and manage challenge participation states per app capabilities.
11.3 Check-in editing/deleting windows and authority.
- Only the creator of a check-in may edit that check-in, within up to 2 hours from creation.
- The creator may delete their check-in within up to 2 days from creation.
- Admins may delete check-ins and manage members, but may not edit check-ins created by other users.
11.4 Challenge edit locks after start. After a Challenge starts, the scoring mode and prize settings cannot be changed.
11.5 Winner determination logic. Challenge winners are determined by configured scoring metrics from active members. In tie situations, prize distribution is split equally among tied winners where prize logic applies. If no valid top score exists (e.g., zero-result scenario), a Challenge may complete without payout distribution.
11.6 Movva intervention. Movva may investigate credible abuse, manipulation, fraud, or policy violations and may suspend accounts/challenges, reverse or withhold payouts, and preserve records for review.
11.7 No guarantee of outcome. Movva does not guarantee individual challenge outcomes, user performance, or winnings.
12. Taxes
12.1 User responsibility. Users are solely responsible for determining and paying any taxes, duties, levies, or reporting obligations arising from prizes, withdrawals, or other amounts received.
12.2 Withholding/compliance. Movva may request additional information if legally required for compliance, anti-fraud, or tax reporting obligations.
13. Privacy and Personal Data for Payouts
13.1 Data categories collected. Depending on flow, Movva may collect:
- Authentication/account data: display name, email, password (or Apple auth identity), Terms acceptance metadata, country, currency
- Challenge/check-in data: title, description, dates, metrics, optional images, tracker metadata (e.g., Apple Fitness workout IDs/types)
- Payout data:
- BRL/PIX: full name, CPF, PIX key type and key
- USD/NZD/Wise: full name and email
- Support/contact data: message topic, message text, reply email
13.2 Purpose of processing. Movva processes data to provide account access, operate challenges, calculate rankings/results, process payments/withdrawals, prevent fraud/abuse, and provide support.
13.3 Third-party sharing for operations. Movva may share strictly necessary data with payment and transfer providers, including Stripe, EFIBank, and Wise, and with infrastructure providers as needed to operate the service.
13.4 Data minimization. Movva seeks to collect the minimum data reasonably necessary for each function.
13.5 Privacy Policy links.
13.6 Data retention.
- General user data (personal data, challenge/check-in data, and logs) is retained for 1 year after a user requests account deletion.
- Payment and transaction records are retained for 5 years for tax and accounting purposes.
14. Intellectual Property
14.1 Movva IP. Movva and its licensors retain all rights in app code, branding, UI, text, graphics, and service content (except user-submitted content).
14.2 Limited license. Movva grants a limited, revocable, non-exclusive, non-transferable license to use the app for personal, lawful use.
14.3 Restrictions. You must not reverse engineer, scrape, automate abusive extraction, or exploit Movva content/services beyond permitted use.
15. Disclaimer of Warranties and Limitation of Liability
15.1 As-is service. The service is provided on an “as is” and “as available” basis, subject to maintenance windows, outages, and third-party dependencies.
15.2 No universal warranty. Movva does not warrant uninterrupted operation, error-free service, or guaranteed fitness outcomes.
15.3 Liability limits. To the maximum extent permitted by applicable Brazilian law, Movva is not liable for indirect, incidental, consequential, exemplary, or punitive damages arising from service use, challenge participation, or third-party provider failures.
15.4 Mandatory legal protections preserved. Nothing in these Terms excludes liability where exclusion is prohibited by law, including non-waivable consumer rights under applicable law.
16. Indemnification
You agree to indemnify and hold Movva and its affiliates, officers, and service providers harmless from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your unlawful conduct, Terms violations, infringement, fraud, or misuse of the service.
17. Termination and Suspension
17.1 By user. You may stop using Movva at any time, subject to any ongoing challenge/payment state that still requires resolution.
17.2 By Movva. Movva may suspend or terminate access for abuse, fraud, security risk, legal compliance needs, or material Terms violations.
17.3 Effect. On suspension/termination, access may be restricted and unresolved balances/payouts may be held pending verification/compliance review.
18. Governing Law, Arbitration, and Jurisdiction
18.1 Applicable law. These Terms are governed by the laws of Brazil.
18.2 Arbitration option included. For rights that are legally arbitrable, the parties may resolve disputes by arbitration under the Brazilian Arbitration Act (Law No. 9,307/1996), with seat in Santa Catarina, Brazil, and proceedings in Portuguese, if both parties agree to arbitrate the specific dispute.
18.3 Judicial forum. In the absence of a valid arbitration agreement for a specific dispute, or where arbitration is not legally applicable, the courts of Santa Catarina, Brazil, are the elected forum, subject to mandatory legal venue and consumer-protection rules.
19. Changes to Terms
19.1 Updates. Movva may update these Terms from time to time.
19.2 Notice and effect. Updated versions become effective on publication with a revised effective date/version history. Continued use after changes indicates acceptance of the updated Terms.
